Terms and Conditions for attendees for attendees of Second Life Upcycling classes and workshops.
1. Agreement to Terms
By registering for and attending any classes or workshops (hereinafter referred to as “the Workshops”) organised by Second Life Upcycling, you agree to be bound by these Terms and Conditions. Your participation in the Workshops signifies your understanding and acceptance of these terms.
2. Health and Safety
Attendees acknowledge that the Workshops may involve the use of mechanical equipment such as sewing machines and sharp tools, including but not limited to scissors, pins, needles, rotary cutters, and other potentially hazardous items.
While every reasonable precaution will be taken to ensure a safe learning environment, attendees understand and agree that:
- Risk of Injury: There is an inherent risk of injury when using mechanical equipment and sharp tools. Attendees must exercise caution and follow all safety instructions provided during the Workshops.
- Responsibility for Personal Safety: Attendees are responsible for taking all necessary precautions to ensure their personal safety. This includes, but is not limited to, following all guidelines and instructions provided by instructors, using equipment properly, and taking care around sharp implements.
3. Liability Waiver
By participating in the Workshops, attendees agree to the following:
- No Liability for Injuries: Second Life Upcycling, its owners, instructors, employees, or affiliates will not be held liable for any injuries, accidents, or damages sustained by attendees during the Workshops. This includes but is not limited to injuries resulting from the use of sewing machines, sharp tools, or other equipment.
- Personal Responsibility: Attendees acknowledge that they are participating in the Workshops at their own risk and agree not to take any legal action against Second Life Upcycling, its owners, instructors, employees, or affiliates in the event of injury or damage.
4. Age and Skill Level Requirements
Attendees must meet the specified age and skill level requirements for each Workshop as indicated in the class description. Children under the age of 16 are not permitted to attend. For participants aged 16 to 18, parental consent is required to participate in the Workshop.
5. Workshop Conduct
- Instructions and Guidance: Attendees agree to follow all instructions given by the instructor during the Workshops. Failure to do so may result in removal from the class without refund.
- Respect for Equipment: All attendees are expected to handle the provided equipment and materials with care. Any intentional damage to equipment will be the responsibility of the attendee.
6. Cancellations and Refunds
- Cancellations by Attendees: If you need to cancel your attendance, please notify us as soon as possible. Refunds will only be provided for cancellations made at least 48 hours before the start of the Workshop. Cancellations made less than 48 hours prior to the start of the Workshop will incur a cancellation fee of 50% of the workshop cost. Alternatively, you may transfer your workshop attendance to another party (i.e. a friend or family member) if you are unable to attend. If another person is taking your place, please notify us at least 3 hours before the commencement of the Workshop so we can provide them with the necessary information.
- Cancellations by Second Life Upcycling: Second Life Upcycling reserves the right to cancel or reschedule a Workshop if minimum numbers aren’t achieved. In the event of a cancellation, attendees will be notified 48 before the commencement of the Workshop and given the option of a full refund or the opportunity to transfer to another class.
- Refund Processing: Refunds will be processed as soon as possible, but please allow up to 3 business days for the transaction to be completed. The time it takes for the refund to appear in your bank account may vary depending on your bank’s processing times. It is the responsibility of attendees to provide their bank account details for direct deposit processing. Refunds cannot be made to credit cards.
7. Intellectual Property
All materials provided during the Workshops, including but not limited to instructional guides, patterns, and designs, are the intellectual property of Second Life Upcycling. Attendees are not permitted to distribute or sell these materials without prior written consent.
8. Photographs and Recordings
Second Life Upcycling may take photographs or recordings during the Workshops for promotional purposes. Attendees will be advised prior to any photography or video recording taking place. If you do not wish to be included in such media, please inform the instructor before or at the time the notice is given. We will respect your privacy and ensure that you are not filmed or photographed.
Attendees are not permitted to take photographs or videos during the Workshops unless they have received explicit permission from Second Life Upcycling, the instructor, and all other attendees present. This is to ensure the privacy and comfort of all participants.
9. Sewing Machines
Attendees are welcome to bring their own sewing machine to the Workshops. However, Second Life Upcycling is not responsible for the operation, functionality, or transportation of any attendee’s personal sewing machine. Attendees are responsible for ensuring their machine is in proper working order prior to the Workshop.
Sewing machines will be provided for attendees who do not have their own. While every effort is made to ensure that the provided machines are in good working order, we cannot guarantee that they will perform at the level assumed or expected by the attendee.
If attendees are using a supplied sewing machine, they must take all care to use it in a safe and careful manner to avoid damaging the equipment or causing injury to themselves or other attendees. If the instructor deems an attendee to be using the sewing machine in a manner that could potentially damage the machine or pose a risk to others, they may be asked to stop using it and may be required to leave the Workshop. In such cases, no refund will be issued.
10. Parking
Please note that there is no onsite parking available at the Workshop location. Due to a 24-hour clearway, parking is not permitted directly in front of the Workshop premises. However, there is usually ample parking available across the road in Skyline Place or in nearby side streets.
Attendees are responsible for finding their own parking and should plan accordingly to ensure they arrive on time.
If you are bringing your own sewing machine, you may drop it off at the top of the driveway before parking your car.
11. Conduct of Attendees
While every effort is made to ensure that the Workshops provide a safe, welcoming, and inclusive environment, Second Life Upcycling cannot be held responsible for the conduct of other attendees.
We reserve the right to request that any attendee leave the Workshop if their behaviour is deemed inappropriate, disruptive, or offensive to others. In such cases, no refund will be provided. Our priority is to maintain a positive and respectful atmosphere for all participants.
12. Garments and Materials
Depending on the specific Workshop, attendees are welcome to bring along garments or materials to make or alter. However, Second Life Upcycling takes no responsibility for the actions of attendees regarding their own projects. If attendees are not satisfied with the results of their alterations, or with any recommendations provided by instructors or other attendees, they are liable for their own choices.
The organisers assume no responsibility for any mistakes or unhappy decisions made during the Workshops. We encourage all participants to communicate openly with instructors and fellow attendees to achieve the best possible results.
13. Disability Access
Please be advised that there is no disability access at the Workshop location. Attendees will be required to access the workshop room via a gently sloping driveway from the street, followed by seven stairs. If you have any concerns regarding accessibility, please contact us prior to the Workshop to discuss your options.
14. Light refreshments
During the Workshops, light refreshments will be available for attendees to enjoy. Unfortunately, we cannot cater to the specific dietary or allergy requirements of individual attendees.
Second Life Upcycling is not responsible for any allergies or specific dietary requirements of attendees. Participants are encouraged to inform us of any dietary restrictions beforehand, but it remains the responsibility of attendees to ensure their own safety regarding food and beverage consumption.
15. Class Timing
Classes run for a designated duration as specified in the workshop details. Attendees are welcome to arrive 15 minutes prior to the starting time to settle in and prepare for the Workshop.
To ensure a smooth transition for subsequent classes or activities, we kindly request that attendees leave within 15 minutes of the conclusion of the Workshop. Your cooperation is appreciated and helps us maintain an organised schedule.
16. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts of NSW.
17. Changes to Terms and Conditions
Second Life Upcycling reserves the right to modify or update these Terms and Conditions at any time. Attendees will be notified of any changes before the start of the Workshop.
By registering for and attending the Workshops, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
